These Terms of Use ("Terms") govern your access to and use of the Gravity of Destiny™ mobile application and website (collectively, the "Service") provided by HeroRocket Interactive ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
The Service is intended for users who are at least 13 years of age. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service and agree to these Terms.
2. License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Gravity of Destiny application on your personal device solely for your personal, non-commercial entertainment purposes. This license does not include the right to:
- Copy, modify, or distribute the App or any of its content
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels
- Use the App for any commercial purpose without our prior written consent
3. In-App Purchases and Subscriptions
Gravity of Destiny offers optional in-app purchases, including a premium subscription ("Odyssey Mode") available in three tiers: Monthly ($3.99/month), Annual ($29.99/year), and Lifetime ($49.99 one-time). All purchases are processed through the Apple App Store and governed by Apple's terms and conditions.
Subscriptions: Monthly and annual subscriptions auto-renew until cancelled. You may cancel at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period — you will continue to have access to premium features until that time.
Refunds: All purchases are final and non-refundable except as required by applicable law or as provided by Apple's refund policies. To request a refund, contact Apple directly through your App Store account.
Virtual Currency: Stardust earned within the App has no monetary value, cannot be transferred, sold, or exchanged for real currency, and is subject to forfeiture upon account deletion or if the App is discontinued.
4. User Conduct
You agree not to use the Service to:
- Cheat, exploit bugs, or use third-party software to gain unfair advantages
- Interfere with the proper operation of the Service or its servers
- Attempt to gain unauthorized access to any part of the Service
- Engage in any conduct that is unlawful, harmful, threatening, or otherwise objectionable
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of HeroRocket Interactive and its licensors. The Gravity of Destiny™ name, logo, graphics, sounds, and all related elements are trademarks or trade dress of HeroRocket Interactive. You may not use any of these without our prior written permission.
6. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GRAVITY OF DESTINY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX MONTHS PRIOR TO THE CLAIM, OR $10 USD, WHICHEVER IS GREATER.
8. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your license to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall do so.
9. Changes to These Terms
We may revise these Terms at any time. When we make material changes, we will update the effective date at the top of this page. Your continued use of the Service after the updated Terms are posted constitutes your acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in California.
